SB 1615 Summary

• Reduces possession of drug paraphernalia with intent to use from a class 6 felony to a class 3 misdemeanor.

• Reduces delivery or manufacture of drug paraphernalia with intent to deliver from a class 6 felony to a class 1 misdemeanor, except it remains a class 6 felony for repeat offenders or when delivered to minors by someone at least 18 years old and 3+ years older than the minor.

• Reduces advertising drug paraphernalia from a class 6 felony to a class 1 misdemeanor, except it remains a class 6 felony for repeat offenders.

• Excludes narcotic drug testing products used to detect fentanyl or fentanyl analogs from the definition of drug paraphernalia.
