SB1633 Summary

• Amends Arizona harassment statute (A.R.S. § 13-2921) to require that harassment consist of conduct knowingly and repeatedly committed or any single act committed in a manner that harasses another person.

• Clarifies that harassment includes contacts or communications by any means (verbal, electronic, mechanical, telegraphic, telephonic, or written) made in a harassing manner.

• Redefines "harass" to mean conduct directed at a specific person that would cause a reasonable person to be seriously alarmed, annoyed, humiliated, or mentally distressed.

• Expands aggravated harassment provisions under A.R.S. § 13-2921.01 to include violations of emergency orders of protection, conditions of release prohibiting contact, and previous convictions against the same victim.

• Establishes sentencing guidelines where aggravated harassment involving certain court orders is a class 6 felony (or class 5 felony for second or subsequent violations), and aggravated harassment involving prior convictions is a class 5 felony.
