HB 2083 Summary

• Landlords must disclose to tenants at or before tenancy begins: the exact rent amount and due date, all additional fees and costs (including trash valet, smart device upgrades, online payment service fees), and whether landlords or vendors collect or sell tenant personal data.

• Landlords must include fee disclosures in any advertisement or promotional material that states the periodic rental rate, including web-based materials.

• Tenants may choose not to pay for nonessential services such as valet trash service and smart home device fees, and may pay rent using any legal tender including cash, checks, cards, and online payment systems without additional fees.

• Landlords cannot charge late fees if rent is paid in full within five days after the due date, and additional fees may only be assessed on the same date the rental payment is due.

• Revises landlord acceptance of partial rent payments to clarify that accepting partial payment does not waive the right to terminate for nonpayment unless the tenant meets obligations under a written partial payment agreement.
