Increases maximum civil penalty for violations of health care institution statutes or rules from $500 to $1,000 per violation, with each day of violation counting as a separate violation.

Requires the department to consider nine factors when determining penalty amounts, including severity of violations, potential for harm, threats to health and safety, number of persons affected, and facility size.

Maintains existing procedures for assessing penalties, issuing notices of assessment, and allowing persons to appeal through administrative hearings under title 41, chapter 6, article 10.

Clarifies that civil penalties assessed under federal Medicaid regulations (42 U.S. Code section 1396r) are deposited into the nursing care institution resident protection revolving fund for purposes including resident relocation costs and facility operation maintenance.

Directs penalties assessed under the increased state penalty provision to be deposited in the state general fund.
