HB 2384 Summary

• Expands earned release credits for prisoners convicted of drug offenses in Title 13, Chapter 34 to five days for every six days served (increased from three days per seven days) if they complete treatment or work programs and have no violent felony convictions.

• Creates a tiered earned release credit system: one day per six days served for all prisoners, plus additional credits for drug offenders meeting requirements, plus two days per six days for other prisoners meeting program participation requirements.

• Eliminates the functional literacy requirement as a barrier to earned release credit eligibility, allowing prisoners without eighth-grade literacy to be released to the transition program while pursuing literacy education.

• Requires the Department of Corrections to report annually to the Governor and Legislature on recidivism rates, number of prisoners earning credits, program participation, forfeited credits, and transition program enrollment and outcomes.

• Applies to all prisoners serving sentences on or after the effective date, with retroactive application to prisoners who met eligibility requirements before enactment.
