Commercial workers' compensation insurers covering firefighters and fire investigators may charge additional premiums to fire districts to recover COVID-19-related claims costs paid before July 1, 2023, limited to reimbursement amounts available through the American Rescue Plan Act of 2021.

Maximum additional premium per insurer is $800,000, and insurers may only charge if the policy includes a provision allowing additional premiums.

COVID-19-related claims costs recovered through additional premiums may not be included in experience modifications charged to fire districts.

Legislature intends that this provision not delay payment of fire districts' eligible COVID-19 expenses by the Industrial Commission of Arizona using American Rescue Plan Act funds from the 2022-2023 budget.

Section repeals December 31, 2024.
