HB 2441 Summary

• City or town water providers in counties with populations exceeding 1.5 million must execute treat and transport agreements with third parties to provide standpipe water service for up to three years to unincorporated communities adjacent to their service areas.

• Service applies only to areas with 750 or fewer residences that previously received standpipe service under the city's or town's drought management plan and have no other water source within 10 miles.

• Water haulers may receive up to 150 acre-feet annually at standpipes at a cost not exceeding $20 per 1,000 gallons, with self-hauling permitted.

• Cities and towns are not liable for actions after water is delivered by haulers and are not obligated to provide standpipe service outside their utility service areas unless required by law or contract.

• The requirement expires December 31, 2025.
