AZ HCR2009

Proposes amendment to Article VII, Section 2 of the Arizona Constitution to establish voting as a fundamental right requiring laws that burden voting to be narrowly tailored to further compelling governmental interests.

Changes voter qualification language from "no person shall be entitled" to "every person is entitled" to vote, updating phrasing while maintaining citizenship, age 18, and state residency requirements.

Adds new subsection establishing that the right to vote is fundamental and provides protection beyond the equal protection clause of the Fourteenth Amendment to the U.S. Constitution.

Modifies felony disenfranchisement provision to disqualify only those adjudicated as incapacitated persons or convicted of treason, removing the blanket ban on voting by felons unless they are restored to civil rights.

Directs the Secretary of State to submit the proposition to voters at the next general election.
