HCR 2040 Summary

• Repeals sections 16-544 and 16-545 (Arizona Revised Statutes) related to the active early voting list and early ballot procedures.

• Renames "early voting" to "absentee voting" throughout election law and establishes eligibility criteria for absentee ballots including absence from precinct, physical inability to vote, age 65+, religious reasons, and absent uniformed services or overseas voters.

• Eliminates automatic mailing of sample ballots to voters on an active early voting list; sample ballots must now be mailed to all registered voters except those who request otherwise.

• Requires election precincts to contain no more than 1,000 registered voters and prohibits the use of voting centers as alternatives to designated polling places.

• Directs the Secretary of State to submit this measure to voters at the next general election for approval as a constitutional referendum.
