SB 1027 Summary

• Adds manufacturing carfentanil, fentanyl, or fentanyl mimetic substances under circumstances causing physical injury to a minor under 15 years of age as a dangerous crime against children in the first degree (Section 13-705).

• Creates mandatory sentencing for manufacturing carfentanil, fentanyl, or fentanyl mimetic substances that injure minors: 13-27 years imprisonment (minimum-maximum), with enhanced penalties for repeat offenders.

• Establishes mandatory minimum sentences of 5-15 calendar years for possession, manufacture, or sale of heroin, carfentanil, fentanyl, or fentanyl mimetic substances; 10-20 years for repeat offenders (Section 13-3408).

• Removes threshold amount requirement for mandatory sentences when drugs involved are heroin, carfentanil, fentanyl, or fentanyl mimetic substances.

• Creates new offense under Section 13-3408.01 making it a class 2 felony to knowingly manufacture carfentanil, fentanyl, or fentanyl mimetic substances under circumstances causing physical injury to a minor.
