SB 1030 Summary

• Requires counties to adopt zoning ordinances regulating drag shows and drag performers as adult oriented businesses, including permits for drag show establishments and performers.

• Defines "drag performer" as a person who dresses in clothing and uses makeup opposite their gender at birth to exaggerate gender signifiers and engages in singing, dancing, monologues or skits to entertain an audience.

• Defines "drag show" as a performance for entertainment with one or more performers using clothing and makeup opposite their gender at birth to entertain an audience of two or more people through singing, dancing, monologues or skits.

• Prohibits drag shows from operating between 1:00 a.m. and 8:00 a.m. Monday through Saturday, and between 1:00 a.m. and 12:00 noon on Sunday, with violations classified as a class 1 misdemeanor.

• Allows counties and municipalities to enact ordinances regulating drag shows in a manner at least as restrictive as the state-mandated operating hours restrictions.
