SB 1034 Summary

• Prohibits homeowners' associations in condominiums and planned communities from banning the outdoor display of the American flag, POW/MIA flag, Arizona state flag, Arizona Indian nations flag, Gadsden flag, first responder flags, and blue/gold star service flags, unless the flag is obscene, defamatory, or likely to incite violence.

• Allows associations to adopt reasonable rules regarding flag placement and manner of display, and may regulate flagpole location and size, but cannot prohibit installing a flagpole; planned communities may limit members to displaying no more than two flags at once and restrict flagpole height to rooftop height.

• Defines "first responder flag" with specific color and design requirements for law enforcement (blue, black, white with police shield), fire department (red, gold, black, white with Maltese Cross), and paramedics/EMTs (blue, black, white with star of life).

• Applies the flag display protections to both condominium associations under section 33-1261 and planned community associations under section 33-1808, with similar provisions for political signs, for sale/rent/lease signs, and community assembly rights.
