SB 1047 Summary

• Amends criminal trespass in the third degree (A.R.S. 13-1502) to add a new category prohibiting entry or remaining in areas designated by law enforcement as "no trespassing" with police tape, barriers, or barricades, or at active law enforcement intervention sites including crime scenes, accidents, civil disturbances, or investigations.

• Maintains criminal trespass in the third degree as a class 3 misdemeanor offense.

• Amends the offense of refusing to aid a peace officer (A.R.S. 13-2403) to include a new requirement to remain at a reasonable distance as determined by the officer during active intervention in dangerous or potentially violent criminal situations involving threatening, agitated, or emotionally unstable persons.

• Preserves immunity from civil liability for persons who reasonably comply with peace officer commands to aid in arrest or crime prevention.

• Maintains refusing to aid a peace officer as a class 1 misdemeanor offense.
