SB 1064 Summary

• Amends Arizona law to increase sentencing for drug offenses committed in drug-free school zones by adding one additional year to presumptive, minimum, and maximum sentences, in addition to any other applicable enhancements.

• Creates a new "drug-free neighborhood zone" covering areas within 300 feet of hospitals, nursing homes, drug treatment centers, mental health facilities, public parks, and bank entrances/exits with the same one-year sentence enhancement for drug sales or transfers.

• Requires convicted persons to pay a minimum fine of $2,000 or three times the drug value (whichever is greater) for offenses in either zone, with judges prohibited from suspending any portion of the fine.

• Establishes that persons convicted under these provisions are ineligible for sentence suspension, probation, pardon, or early release except under limited circumstances, until the sentence is served or commuted.

• Requires cities, towns, county boards of supervisors, or nonpublic facility administrators to place permanent signs and file maps with the county recorder and county attorney identifying drug-free neighborhood zone boundaries.
