SB 1097 Summary

• Amends A.R.S. § 28-1106 to restrict local authorities from prohibiting or limiting trucks on major arterial streets unless a test drive or vehicle template demonstrates that legal-sized vehicles cannot safely operate on the highway.

• Prohibits local authorities from granting categorical exceptions for truck restrictions and prevents highways annexed after December 31, 2022 from being incorporated into existing truck restrictions unless they meet safety criteria.

• Establishes a written review process allowing persons to request reconsideration of truck route restrictions, with the director required to act within 90 days and nullify restrictions if legal-sized vehicles can operate safely.

• Nullifies truck restrictions on major arterial streets that were improved after December 31, 2022 to provide through-traffic between jurisdictions, unless the street meets safety criteria, trucking associations provide written support, or a reasonable alternative route exists within one mile.

• Requires local authorities to repeal or amend ordinances enacted on or after January 1, 2020 that conflict with this act within 90 days or the ordinances become invalid.
