SB 1297 Summary

• Requires automatic voter registration for individuals applying for or renewing a driver license or nonoperating identification license, or making changes to license information, provided they meet voting eligibility requirements.

• Establishes a 21-calendar-day opt-out period during which applicants may decline registration after receiving notice from the county recorder about the automatic registration process.

• Directs the Department of Transportation and Secretary of State to adopt rules implementing automatic voter registration systems that conform license and voter registration applications, transfer registration information electronically, and maintain confidentiality of driver license information.

• Requires the Department of Transportation to provide applicants with voting eligibility requirements, penalties for false registration, and notices about confidentiality of registration decisions and office information.

• Protects individuals who unknowingly register while not qualified to vote from prosecution for false registration or false swearing.

• Effective December 31, 2023.
