SB 1384 Summary

• Prohibits cumulative voting and nominations from the floor in all directors' elections for condominiums and planned communities.

• Requires all eligible candidates nominated for the board of directors to appear on the ballot, with write-in lines equal to the number of directors to be elected.

• Reduces the quorum requirement for annual meetings and director elections to one-tenth of total votes entitled to be cast (unless condominium or community documents specify a lower amount).

• Expands notice delivery methods for meetings to include in-person delivery, mail, and email, and allows absentee and written ballots to be delivered by mail, in-person, email, fax, or online voting systems.

• Requires associations to deliver absentee or written ballots to eligible voters at least 10 days before the ballot deadline and to retain all voting materials for at least one year after completion of elections or meetings.
