SB 1456 Summary

• Amends Arizona law regarding homeowner association (HOA) record requests for both condominiums (section 33-1258) and planned communities (section 33-1805).

• Requires record requests to meet three conditions: made in good faith, describe the proper purpose and specific records with reasonable particularity, and records must be directly connected to the stated purpose.

• Records made available online are deemed reasonably available; associations have 10 business days to fulfill examination requests and provide copies at a maximum fee of $0.15 per page.

• Permits associations to withhold records previously requested within the preceding two years that have not been modified, and to deny requests for records already provided to the requestor.

• Defines "financial and other records" to include specific items such as the declaration, bylaws, member names and addresses, three years of meeting minutes and board actions, current budget and assessments, financial statements from the previous three years, insurance policies, and all current contracts.
