Health care insurers are prohibited from ranking, classifying, or publishing comparisons of health care providers unless standards conform to nationally recognized standards prescribed by the Department.

Insurers must disclose all standards and measures to affected health care providers before any evaluation period begins.

Insurers must provide affected health care providers at least 45 days written notice of proposed rankings or ratings, including the methodologies and data used to make the decision.

Health care providers may request reconsideration within 30 days of receiving notice, with the option to participate via teleconference or in-person, submit documentation, and have a representative present.

Insurers must notify providers in writing of the reconsideration decision and provide specific reasons and facts before publishing or disseminating any ranking, tiering, rating or comparison.
