SB 1573 Summary

• Requires landlords to disclose to tenants at or before lease commencement the exact rent amount, due date, and all additional fees or costs not included in the periodic rental rate, including trash valet, smart device upgrades, online payment fees, and any other charges; these disclosures must also appear in advertisements and web-based promotional materials stating the rental rate.

• Prohibits landlords from charging additional fees for online rent payments made through the landlord's website or system and requires landlords to allow tenants to pay rent and move-in costs using any legal tender including cash, checks, debit cards, credit cards, and bank/financial institution websites.

• Requires landlords to allow tenants to opt out of nonessential services such as valet trash service and smart home device fees, and mandates that additional fees be assessed only on the same date the rental payment is due.

• Establishes that if rent is paid in full within five days after the due date, the landlord may not charge a late fee; clarifies that acceptance of a partial rent payment requires the tenant to agree in writing and does not waive the landlord's right to proceed for nonpayment unless the tenant fails to pay the next regularly scheduled rent.

• Requires landlords to inform tenants in writing that the Arizona Residential Landlord and Tenant Act is available on the Arizona Department of Housing's website and requires landlords to disclose whether they or their vendors collect or sell tenant personal data from facilities or services on the rental premises.
