SB 1574 Summary

• Amends A.R.S. § 12-1178 to require writs of restitution in eviction cases to wait at least 5 calendar days after judgment before issuance and at least 7 calendar days after issuance before enforcement.

• Requires courts to provide defendants found guilty of forcible entry and detainer or forcible detainer with notice that remaining in or returning to the property after being served a writ of restitution constitutes criminal trespass in the third degree.

• Appropriates $290,000,000 from the state general fund in fiscal year 2023-2024 to the Department of Economic Security for rental assistance programs.

• Requires the Department of Economic Security to allocate at least $10,000,000 of the rental assistance funds specifically for persons aged 65 and older.

• Makes the $290,000,000 appropriation exempt from lapsing provisions under A.R.S. § 35-190.
