Repeals and replaces Arizona Revised Statutes Section 14-1306 regarding probate court procedures.

Requires courts to encourage mediation as the initial dispute resolution method and mandate documentation of mediation efforts in the court record.

Establishes a process allowing litigants to demand a jury trial within 30 days after an unsuccessful bench trial, with jury trial to be scheduled within 45 days of the request.

Sets the jury verdict standard at clear and convincing evidence with a three-fourths vote threshold, and allows juries to reexamine portions of bench trial verdicts without relitigating entire matters.

Permits juries to impose civil penalties up to $2,500 for abuse of the section and voids all court orders if the court fails to disclose these provisions to litigants.
