HB2026 Summary

• Adds definition of "residential lease community" to water law as six or more detached single-family residential dwelling units offered for lease under a common promotional plan, excluding agricultural worker housing.

• Extends water supply certificate requirements to residential lease communities with six or more detached single-family residences in active management areas where the Central Arizona Project aqueduct is located (effective October 1, 2023).

• Requires applicants for building permits on such residential lease communities to obtain a certificate of assured water supply from the director or secure a written commitment from a designated water provider before permit approval.

• Subjects residential lease communities to activation fees and replenishment reserve fees under water conservation district rules, with fees paid in full per section 45-576, subsection M.

• Makes detached single-family residences within residential lease communities subject to annual membership dues levied by water conservation districts on a per-unit basis, similar to member land parcels.
