HB 2027 Summary

• Exempts subdivisions in subsequent active management areas from adequate/assured water supply requirements if the subdivision received final plat approval before the AMA designation became effective or received an adequate water report from the director before the AMA effective date.

• Allows subdivisions in municipalities or counties that adopted adequate water supply ordinances to be exempt from those ordinances once the area becomes a subsequent active management area, with those ordinances treated as assured water supply requirements.

• Permits subdivisions in subsequent active management areas that received adequate water reports before the AMA effective date to be exempt from obtaining certificates of assured water supply.

• Makes conforming changes to statutes governing municipal subdivision approval (A.R.S. § 9-463.01), county subdivision approval (A.R.S. § 11-823), and assured water supply designations (A.R.S. § 45-576).

• Establishes the measure as an emergency provision effective immediately upon enactment.
