HB2134 Summary

• Creates new offense of "aggravated unlawful flight from a pursuing law enforcement vehicle" for drivers who wilfully operate motor vehicles in a manner that recklessly endangers another person while fleeing or eluding an official law enforcement vehicle.

• Establishes aggravated unlawful flight as a class 4 felony under standard circumstances.

• Elevates offense to class 2 felony if: serious physical injury results to another person, the driver was transporting a minor under age 15, or the driver was in violation of sections 28-1381 or 28-1382 (implied driving under the influence statutes).

• Requires persons convicted under the class 2 felony provision involving a DUI violation to serve a minimum of 4 months in prison with no eligibility for probation, pardon, commutation, suspension of sentence, or other release until minimum term is served.
