HB 2209 Summary

• Amends sections 23-108.03 and 23-408 of Arizona Revised Statutes to require labor department determinations, penalties and fines to be considered and authorized by a vote of the commissioners.

• Adds restrictions on who may accompany compliance safety and health officers during workplace inspections, limiting accompaniment to employees, authorized representatives, safety consultants, attorneys, and those required by law.

• Establishes employer rights to require third-party inspection accompaniers to follow workplace safety rules, complete safety trainings, sign confidentiality agreements, and prohibits access to trade secret areas.

• Sets termination dates for the Industrial Commission of Arizona (July 1, 2028), Occupational Safety and Health Advisory Committee (July 1, 2032), Boiler Advisory Board (July 1, 2032), and Occupational Safety and Health Review Board (July 1, 2032), with repeal of related statutes effective January 1 of the following year.

• Requires the Industrial Commission to submit state plan proposals to the joint legislative audit committee at least 30 days before submitting to the federal Occupational Safety and Health Administration.
