HB2245 Summary

• Amends Arizona law to establish mandatory sentencing guidelines for fentanyl sales of 200 grams or more: minimum 5 years, presumptive 10 years, maximum 15 years.

• For repeat offenders previously convicted of selling fentanyl in amounts of 200 grams or more: minimum 10 years, presumptive 15 years, maximum 20 years.

• Allows presumptive sentences to be mitigated or aggravated pursuant to existing sentencing guidelines under section 13-701.

• Maintains existing criminal classifications and penalties for other narcotic drug violations including possession, manufacturing, and distribution.

• Short title designated as the "Ashley Dunn Act"; approved by governor April 2, 2024.
