HB2317 - Sober Living Homes

• Amends licensing requirements for sober living homes to eliminate certification by national organizations and require state licensure for all facilities providing housing and recovery services related to alcohol or substance use.

• Establishes mandatory physical, on-site inspections before license approval, renewal, or changes to resident capacity, and at least annually for each home; prohibits self-attestation in lieu of inspections.

• Increases civil penalties from $500 to $1,000 per violation and requires the department to investigate complaints within 30 days and conduct inspections if violations are found.

• Requires the department to issue cease and desist notices to unlicensed homes operating in violation and allows the attorney general to seek injunctions; operating without a license 10 days after notice is a class 1 misdemeanor.

• Mandates the department notify local jurisdictions of all license applications, renewals, and changes within 10 days, and provide investigation findings and enforcement actions taken; requires annual reporting on licensed and unlicensed sober living homes to the legislature.
