Establishes the peace officer nonlethal device fund to be administered by the state treasurer and funded through court surcharges on traffic diversion programs.

Redirects $2 of the existing $9 surcharge on court-authorized traffic diversion programs to the new nonlethal device fund, reducing the amount going to the peace officer training equipment fund from $4 to $2.

Allows monies in the fund to be used exclusively for nonlethal devices for peace officers that do not cause permanent harm or injury when used during apprehension of suspected offenders.

Provides that fund monies are not subject to lapsing of appropriations and authorizes the state treasurer to invest and reinvest fund monies, with investment earnings credited back to the fund.
