HB 2365 Summary

• Repeals Title 11, Chapter 7, Article 8 of Arizona Revised Statutes and sections 13-1509, 13-2928, 13-2929, and 41-1724.

• Removes language from section 13-2319 (smuggling) that authorized peace officers to stop persons based on reasonable suspicion of civil traffic violations and removes an entrapment defense from sections 23-212 and 23-212.01 (unauthorized alien employment).

• Amends section 13-3883 to remove arrest authority for persons who have committed public offenses making them removable from the United States.

• Amends section 28-3511 to remove vehicle removal and impoundment provisions related to transporting or harboring aliens in violation of federal immigration law.

• Modifies section 12-116.04 to redirect penalty assessment funds away from the gang and immigration intelligence team enforcement mission border security subaccount and instead deposit funds in the public safety equipment fund.
