Amends Arizona Revised Statutes Section 13-3985 regarding the effect of acquittal on merits in criminal cases.

Clarifies that a defendant acquitted on the merits is acquitted of the same offense despite any defects in form or substance in the indictment or information.

Establishes that a defendant who is acquitted on the merits and retained private counsel may be awarded reasonable attorney fees and costs.
