HB2504 Summary

• Prohibits insurance coverage (health, disability, and group policies) for genetic sequencing performed on devices produced by foreign adversaries or companies domiciled in foreign adversaries, and for organ transplants involving China or Hong Kong Special Administrative Region.

• Defines "foreign adversary" as China, Russia, Iran, North Korea, Cuba, Venezuela, Syria, Hong Kong, or any country/entity engaging in forced organ harvesting.

• Requires health care institutions and research facilities to cease using genetic sequencers and software produced by foreign adversaries by December 31, 2025, with annual attorney certification of compliance.

• Establishes civil penalties of $20,000 per violation for institutions using prohibited genetic sequencers, and entitles patients to statutory damages of at least $1,000 per instance their genome was processed with prohibited technology.

• Requires all genetic sequencing data be stored in the United States with encryption and access restrictions, and invalidates organ donation documents originating from foreign adversaries under state law.
