HB 2570 Summary

• Prohibits municipalities from requiring homeowners' associations, condominium associations, or other associations in new residential developments.

• Prevents municipalities from mandating shared features or amenities that require association maintenance, except for stormwater management purposes.

• Prohibits municipalities from requiring screening, walls, fences, or private streets and roads in new developments.

• For new developments of 5+ acres zoned for single-family homes, caps minimum lot sizes at 1,500 square feet and prohibits municipalities from setting minimum home square footage, lot coverage, or setbacks greater than 5 feet (side) and 10 feet (front/rear).

• Prevents municipalities from enforcing design, architectural, or aesthetic requirements for single-family homes except in historic districts or areas listed on the national register of historic places; applies to municipalities with populations over 70,000 in designated urban areas or on tribal land.
