AZ HB2698

Adds section 33-1820 to Arizona Revised Statutes governing declarant control in planned communities.

Requires all declarations providing for declarant control to specify a termination date or method for calculating the termination date.

Mandates that declarant control terminates no later than when the second to last lot in the planned community is conveyed to a buyer, regardless of what community documents provide.

Requires the association to maintain common areas at the same level the declarant provided and prohibits the association from impeding the declarant's ability to develop, construct, and sell remaining lots or access common areas.
