AZ HCR2010

Prohibits private firearm sales or transfers unless conducted through a licensed firearms dealer who must perform background checks under federal law (18 U.S.C. § 922(t)) and state/local law.

Allows licensed dealers to charge a maximum $20 fee to cover administrative costs when facilitating transfers between unlicensed parties.

Requires dealers to return firearms to the original owner if the purchaser fails a background check, or deliver the firearm to law enforcement within 24 hours if the original owner also fails a background check.

Exempts law enforcement, military/federal officials, gunsmiths, common carriers, shooting range loans, family gifts (including spouses, domestic partners, parents, children, siblings, grandparents, grandchildren, nieces, nephews, first cousins, aunts, and uncles), antique firearms, inherited firearms, and emergency transfers to prevent imminent death or great bodily harm.

Makes violations a class 5 felony; submits the measure to voters at the next general election pending voter approval and gubernatorial proclamation.
