Senate Bill 1025 - DUI Threshold; Drivers

• Expands DUI violations to include drivers of vehicles for hire (as defined in section 28-9501) and transportation network company drivers (as defined in section 28-9551) with an alcohol concentration of 0.04 or more, matching the threshold for commercial motor vehicle drivers.

• Adds new paragraph 5 to section 28-1381(A) making it unlawful for transportation network and for-hire vehicle drivers to operate while having 0.04 or more alcohol concentration.

• Updates sections 28-1321, 28-1385 to include transportation network and for-hire vehicle drivers in the implied consent testing procedures and administrative license suspension provisions triggered by 0.04 or more alcohol concentration.

• Applies the same suspension, testing, and restricted license requirements to transportation network and for-hire vehicle drivers as currently apply to commercial motor vehicle operators.

• Effective April 8, 2024.
