Senate Bill 1041 Summary

• Amends Arizona Revised Statutes § 45-576 to create a new "groundwater savings certificate" as an alternative to the existing "certificate of assured water supply" for subdivisions in active management areas.

• Establishes that groundwater savings certificates require applicants to demonstrate wells can operate continuously for 100 years without exceeding a depth to water of 1,000 feet and must be enrolled as member land in a groundwater replenishment district.

• Requires applicants for groundwater savings certificates to relinquish all claims to sewage produced from water use on the land to the authorized sewage treatment provider.

• Directs the director to adopt rules by January 1, 2025 allowing reduction in water demand for groundwater savings certificate applications if gray water systems meeting department of environmental quality standards are installed.

• Provides conforming legislation direction to the legislative council staff for the fifty-seventh legislature's first regular session.
