Law enforcement and prosecution agencies must withhold the names of deceased or seriously injured accident victims from public records for at least 24 hours after the accident.

Names may be disclosed before 24 hours if a court orders disclosure, the injured person consents, or an immediate family member of the deceased or injured person consents.

The withholding requirement does not apply to records transmitted between law enforcement, prosecution agencies, courts, and court clerks.

The withholding requirement does not affect discovery processes or conduct of trials under existing law.

The act is cited as "Brett's Law."
