Senate Bill 1182 Summary

• Requires Arizona public schools to provide reasonable accommodations to students unwilling or unable to use multioccupancy shower rooms designated for their sex, upon written request and submission of satisfactory evidence of sex.

• Permits schools to offer single-occupancy shower rooms or employee shower rooms as reasonable accommodations, but prohibits access to opposite-sex shower rooms while opposite-sex persons are present.

• Allows schools to adopt policies permitting opposite-sex shower room access for custodial/maintenance work, emergency medical assistance, or addressing emergencies when rooms are unoccupied.

• Establishes private cause of action for individuals whose accommodation requests are denied (unless undue hardship is demonstrated) and for those encountering opposite-sex individuals in designated shower rooms without authorization.

• Permits prevailing plaintiffs to recover monetary damages for psychological, emotional and physical harm, plus reasonable attorney fees and costs; claims must be filed within two years in superior court.
