Senate Bill 1232 Summary

• Sexual conduct with a minor who is 12 years of age or under and who suffers serious physical injury is classified as a class 1 felony punishable by natural life imprisonment without eligibility for commutation, parole, work furlough, work release, or release on any basis.

• Sexual conduct with a minor under 15 years of age is classified as a class 2 felony with punishment pursuant to section 13-705.

• Sexual conduct with a minor who is at least 15 years of age is classified as a class 6 felony, or a class 2 felony if the perpetrator is in a position of trust.

• Defendants convicted under the position of trust provision are ineligible for suspension of sentence, probation, pardon, or release from confinement except as authorized by section 31-233, subsection A or B until the sentence is served or commuted.
