Amends section 36-2854 of Arizona Revised Statutes to regulate marijuana delivery by licensed establishments, effective only with three-fourths legislative approval.

Requires the Department of Health Services to adopt rules allowing and regulating marijuana delivery by January 1, 2025, with deliveries originating from designated retail locations and made only by licensed facility agents in marked vehicles with GPS tracking and video surveillance.

Prohibits delivery to properties owned or leased by the United States, state, political subdivisions, or Arizona Board of Regents, and limits the amount of marijuana products that may be transported in delivery vehicles.

Removes distance limitations between delivery locations and originating retail locations, and allows marijuana establishments to use multiple vehicles for delivery operations.

Establishes a civil penalty of $20,000 per violation for unauthorized marijuana delivery, with penalties deposited into the Smart and Safe Arizona Fund.
