SB 1427 Summary

• Repeals Title 11, Chapter 7, Article 8 and sections 13-1509, 13-2928, 13-2929, and 41-1724 of Arizona Revised Statutes, eliminating various immigration-related provisions and enforcement mechanisms.

• Removes the entrapment affirmative defense from sections 23-212 and 23-212.01 regarding unauthorized alien employment violations.

• Eliminates language in section 13-2319 (human smuggling) that authorized peace officers to stop any person operating a motor vehicle based on reasonable suspicion of civil traffic law violations.

• Removes section 13-3883 paragraph 5, which allowed warrantless arrest of persons believed to have committed offenses making them removable from the United States.

• Removes provisions from section 28-3511 regarding vehicle removal and impoundment related to transporting or harboring aliens in violation of immigration law.

• Eliminates the gang and immigration intelligence team enforcement mission border security subaccount and redirects penalty assessment funds previously allocated to that account toward the public safety equipment fund.
