SB 1432 Summary

• Adds Article 7 to Arizona Revised Statutes Title 33, Chapter 4, establishing the Uniform Unlawful Restrictions in Land Records Act to address discriminatory covenants in property records.

• Allows individual property owners to submit amendments to county recorders to remove unlawful restrictions (based on race, color, religion, national origin, sex, familial status, or disability) from their property deeds without affecting other valid restrictions.

• Authorizes governing bodies of homeowner associations and condominiums to amend governing instruments to remove unlawful restrictions without requiring a member vote, and requires they respond within 90 days to member requests to identify and remove such restrictions.

• Requires amendments to include a conspicuous statement that the removal applies only to unlawful restrictions and does not affect validity of other restrictions, and must be executed, acknowledged, and recorded in land records.

• Prohibits county recorders and counties from being held liable for recording amendments under this article, and clarifies the statute modifies the federal electronic signatures law.
