• Adds definitions for "encapsulating machine" and "pill tableting machine" to drug manufacturing statutes, covering manual, semiautomatic, and fully automatic equipment used to fill capsules or compress tablets with powdered or liquid materials.

• Requires persons selling, transferring, purchasing, or receiving regulated pill tableting and encapsulating machines to report transactions to the Department of Public Safety at least 10 days before delivery (for sellers) or within 3 business days after payment (for buyers).

• Creates exemptions from reporting requirements for licensed pharmacists, registered medical marijuana dispensaries, and registered businesses that use such machines intrinsically to their operations, unless they resell to unlicensed entities.

• Makes it unlawful to fail to submit required reports, furnish false information, or structure transactions to avoid reporting, with violations classified as class 1 misdemeanor for first offense and class 6 felony for subsequent offenses.

• Increases penalty for counterfeiting controlled substances and drugs from class 1 misdemeanor to class 5 felony under section 13-3459.
