SB 1675 Summary

• Amends Arizona Revised Statutes Section 13-105 to modify the definition of "historical prior felony conviction"

• Adds a new provision making prior felony convictions involving "aggravated driving or actual physical control while under the influence" count as historical prior convictions, but only when the current offense is a violation of section 28-1383

• Defines "historical prior felony conviction" to include mandatory imprisonment offenses, dangerous offenses, criminal enterprise offenses, crimes against children, and certain class 2-6 felonies committed within specified timeframes (5-10 years depending on felony class)

• Allows exclusion of time spent on absconder status, escape status, or incarcerated when calculating whether a prior offense falls within the applicable timeframe

• Took effect March 29, 2024
