Senate Concurrent Resolution 1012 Summary

• Requires state agencies to submit proposed rules estimated to increase regulatory costs by more than $100,000 within five years to the Office of Economic Opportunity for review.

• Prohibits proposed rules from becoming effective if the Office of Economic Opportunity confirms costs will exceed $500,000 within five years, unless the legislature enacts legislation to ratify the rule.

• Mandates the Office of Economic Opportunity submit rules to the Administrative Rules Oversight Committee at least 30 days before the next legislative session for submission to the full legislature.

• Allows legislators and regulated persons to request the Office of Economic Opportunity review proposed rules; exempts such rules from standard rulemaking procedures under section 41-1024, subsection B.

• Requires the Secretary of State to submit this measure to voters at the next general election for approval.
