AZ SCR1041

Amends Arizona Constitution Article IV, Part 1, Section 1 to authorize pre-election judicial challenges to the constitutionality of proposed initiative measures or constitutional amendments.

Allows any person to file an action in superior court at least 100 days before an election to contest whether a proposed measure or amendment violates the U.S. Constitution or Arizona Constitution.

Requires courts to immediately hear and decide cases filed 100 days before the election, and prohibits the Secretary of State from certifying or printing unconstitutional measures on the official ballot if a court finds them invalid.

Permits appeals to the Arizona Supreme Court within five calendar days after the superior court enters judgment.

Specifies that this amendment supplements existing legal remedies and does not repeal or preempt other claims, causes of action, or remedies regarding ballot measures.
