House Bill 2109 Summary

• Allows subscription contracts, health insurance policies, and disability insurance plans to limit or deny coverage for human organ transplants and post-transplant care if the transplant operation is performed in the People's Republic of China or Hong Kong Special Administrative Region.

• Permits insurance coverage limitations if the human organ to be transplanted was procured by sale or donation originating in the People's Republic of China or Hong Kong Special Administrative Region.

• Applies to hospital service corporations, medical service corporations, health care services organizations, disability insurers, group/blanket disability insurers, and the Arizona Health Care Cost Containment System (subject to federal Centers for Medicare and Medicaid Services approval).

• Does not require any insurance coverage for human organ transplants and does not prevent insurers from denying coverage for other valid reasons.

• Known as the "Arizona End Organ Harvesting Act"; approved by the Governor on May 6, 2025.
