HB 2202 Summary

• Allows persons in subsequent active management areas to irrigate previously non-irrigated land adjacent to a farm unit that was previously subject to irrigation, provided the irrigation does not exceed the person's awarded irrigation grandfathered right volume.

• Relabels subsections in section 45-452 (from H, I, J, K, L, M to i, j, k, l, m, n) to accommodate the new subsection H regarding irrigation of non-irrigated adjacent land.

• Makes grammatical and clarifying changes throughout sections 45-452, 45-470, 45-472, and 45-473, including replacing "which" with "that" and "prior to" with "before."

• Updates section 45-512 to reflect the relabeling of exemptions in section 45-452, subsection i (formerly H).

• Applies retroactively to August 29, 2022.
