HB 2278 Summary

• Adds requirements that unit owners' records requests must be made in good faith, describe the proper purpose with reasonable particularity, and have records directly connected to that purpose.

• Clarifies that records made available online are deemed reasonably available and exempts associations from providing records previously provided to the requesting owner within two years if unmodified.

• Defines "financial and other records" to include only specific documents: declaration, agent contact information, bylaws, owner names and addresses, meeting minutes (3 years), current budget, assessments, financial statements (3 years), audit reports, current contracts, insurance policies, and electronic board records (3 years).

• Changes copy fees from fifteen cents to $.15 per page and specifies the fee applies to both physical and digital copies, paid when copies are made available.

• Applies identical amendments to both condominium associations (section 33-1258) and planned community associations (section 33-1805).
